Austin, Texas – A 17-year-old was detained and charged with many felonies for allegedly attempting to enter a downtown Austin bar with a weapon.

According to an arrest affidavit, Xavier Sistrunk has been charged with third-degree felony in places where weapons are forbidden, third-degree felony possession of a prohibited weapon, and state-jail felony possession of narcotic substances.

According to court documents, at about 1:30 a.m. on November 12, an Austin police officer was alerted by bar personnel in the 400 block of E. 6th Street to someone attempting to enter with a weapon in his waistband. The bar staff turned him away after overhearing him discussing the gun with a friend, who told him to “just go put it in the car.”

The guy was described as a Black male wearing a red hooded sweatshirt with white numerals on the back and last seen walking down E. 6th Street towards Trinity Street. While speaking with staff, the officer observed someone who matched the description walking out of another establishment. According to court documents, staff then confirmed to the officer that this was the person they thought to have the pistol.

Officers observed the subject, later identified as Sistrunk, going along E 6th before crossing at E 6th and Trinity as the crosswalk sign had a red hand signaling stop. Officers originally detained him for this, identifying themselves as police and seizing him. According to the affidavit, Sistrunk “immediately tensed up, dropped his hands down towards his front waistband, and began reaching for something in the area.”

According to court documents, despite officers’ warnings to “stop reaching,” Sistrunk continued to pull away and go for his waistline. An officer reported knocking Sistrunk to the ground and handcuffing him before searching him and discovering a weapon hidden inside his underwear.

The gun was recognized as a Glock.40 caliber pistol that had been modified with a “Glock switch” to make it automatic, according to the affidavit.

According to court documents, Sistrunk also had a small bag containing 0.6 grams of cocaine in his pocket.
