At 1:29 p.m., Chair Don Boren called the meeting to order. The standard opening statement was read by staff facilitator Stephen Murray, who also acknowledged a quorum. Farda seconded Johnson’s motion to approve the minutes of the July 9 meeting. Cranz was the only person to abstain from the motion. According to the meeting agenda, the following cases were examined for commission approval of staff recommendations.
Ty Thompson, an applicant from Baird Hampton & Brown Inc., asked for an extension so he could edit the application. Cranz seconded Henderson’s motion to send the issue to the regular meeting on August 20. The motion was unanimously approved.
In this linked instance, applicant Thompson also asked for a continuance. Lamberth seconded Henderson’s motion to send the issue to the regular meeting on August 20. The motion was unanimously approved.
In an unsuccessful attempt to get the applicant to attend the hearing and answer questions, this matter was tabled until later in the meeting. The plan was too far away to be considered for annexation anytime soon, according to staff, even though the Fort Worth Fire Department had not examined it because of jurisdictional issues. Additionally, Cranz pointed out that the applicant had sent a letter that clearly outlined the request.
Claymore Engineering Inc., applying on behalf of MRW2 LLC
The staff recommends: 1) that Section 31-101(d)(1) of the Subdivision Ordinance be waived to permit a residential development with a connectivity index of 1.0 instead of the minimum required 1.4; 2) that Section 31-102(b)(2) of the Subdivision Ordinance be waived to exempt future connections with adjacent unplatted lands east and west of the proposed subdivision from the requirement to extend streets to the plat boundary; 3) that Section 31-106(d)(1) of the Subdivision Ordinance be waived to permit a cul-de-sac serving 1-acre or larger lots to be 1,691 feet long instead of the maximum permitted 1,350 feet; and 4) that the preliminary plat be conditional approval of the preliminary plat if the platting comments in the staff report are met.
Action: Crane seconded Farda’s move to approve the staff recommendation. The motion was unanimously approved.
Section 1: Council District 3 IV.VA-25-008. Vacation of a section of the North Service Street right-of-way next to Lot B-R, Block 1, Western Hills Addition
The applicant had asked for this case to be prolonged to the regular meeting on August 20 prior to the meeting. Henderson seconded Tidwell’s motion to continue. The motion was unanimously approved.
V.PP-24-008.Maverick; amendment/waiver request to Section 31-106(d)(1): 15 private open space lots and 178 single-family detached residential lots. District 3 Council
Applying on behalf of PMB Rolling V South Land LP is LJA Engineering Inc.
It is recommended by the staff that Section 31-106(d)(1) of the Subdivision Ordinance be waived in order to permit 33 lots on a cul-de-sac instead of the maximum of 30 lots; and that the preliminary plat revision be approved conditionally once the staff report’s comments are addressed.
The applicant’s representative was Ryan Burgess. He pointed out that the request was motivated by the topography of the area, which included the Fort Worth/Benbrook city limit line to the east and Dutch Branch Creek to the north. He also talked about the features of the houses that will be constructed on this land, specifically that each one would have a sprinkler system and other improvements. Henderson also responded to a question by pointing out that the three extra residences that exceeded the regulation limit were situated close to the point of entrance, which was more in line with the policy’s intent but still required a waiver. Although Tidwell praised the sprinklers’ inclusion, he questioned how the builder could be held responsible for their installation. Following some deliberation, city attorney Richard McCracken suggested that the motion to approve the request contain this restriction.
Tidwell moved to approve the staff’s suggestion, adding that sprinkler systems be installed in every home. Johnson gave a second. The motion was unanimously approved.
VI.PP-25-010. Prose Basswood; one commercial lot and one multifamily lot are being waived under Section 31-106(c)(7). District 4 Council
Westwood Professional Services, applying on Alliance Realty Partners LLC’s behalf
The staff recommends: 1) that Section 31-106(c)(7) of the Subdivision Ordinance be waived to exempt Sandshell Boulevard’s extension to the northern plat border; and 2) that the final plat be approved conditionally after the platting comments in the staff report are addressed.
In this situation, the Subdivision Ordinance’s Section 31-106(c)(7) is being waived to exempt the extension of Sandshell Boulevard to the northern plat boundary. One of the applicants, who plans to buy a portion of the land and turn it into multifamily units, was represented by a WebEx participant. They are not, however, buying the portion of the land covered by the waiver. The request could not be handled by the current owner. The online speaker responded to Lamberth’s query by stating that the area impacted by the waiver will not be included in their final plan.
After commissioners Murray and McCracken conferred, Lamberth made a motion to reject the waiver and approve the preliminary plat, provided that the road be expanded to conform with the ordinance. The motion was overwhelmingly approved when Johnson seconded it.
Other business-related issues:
Speaking on behalf of the applicant was Scott Martsolf (ACS). Further development on the already platted northern parcel will be accelerated by the unoccupied Oncor auxiliary building. Henderson seconded the move made by Tidwell to approve. The motion was unanimously approved.
At 2:20 p.m., the chair adjourned the meeting after expressing gratitude to the commissioners for attending Friday’s training.
