Migrant Arrested by ICE After Massachusetts Court Refuses to Honor Detainer

The arrest of a law-breaking immigrant in Massachusetts who had been in the country unlawfully for almost two years was recently publicized by Immigration and Customs Enforcement (ICE).

In addition to many assault and battery counts, Julio Esteban Batista-Castillo, 24, was charged with kidnapping, malicious destruction of property, breaking and entering, and home invasion. On November 18, ICE authorities took him into custody in Boston.

The suspect entered the country unlawfully in January 2023, according to a news statement issued by ICE on Tuesday.

Batista-Castillo was placed under ICE custody after the Roxbury District Court failed to fulfill an immigration detainer, according to a statement from Enforcement and Removal Operations (ERO) Boston acting Field Office Director Patricia Hyde. Prior to his ICE detention, he had been arraigned by the court.

“Batista has been accused of very serious crimes, including assault and battery involving strangulation and a firearm,” Hyde stated. “This is not someone you want to release into the community.”

Hyde went on to say that by refusing to keep him, the court endangered the Boston community.

“ERO Boston lodged an immigration detainer against him with the Roxbury District Court — a simple request for law enforcement officers to hold him in custody for a short time so our officers could arrest him in a safe, controlled setting,” she continued. “Unfortunately, the detainer was not honored, putting everyone in the community and our officers at risk.”

ICE Boston has arrested innumerable dangerous migrants this year, including Batista-Castillo. ICE officers detained Belardis Tapia Gonzalez, an MS-13 gang member, in Lynn, Massachusetts on Nov. 18 on charges of second-degree child abuse.

In October, ICE officers in Boston apprehended Mateo Hincapie Cardona, another accused child abuser.

He was charged with distributing pornographic material, seducing a minor under the age of sixteen, and engaging in lewd posing and displaying a youngster in the nude.
